Terms of Service

Welcome to RecruiterForce! These Terms of Service (“Terms”) govern your access to and use of RecruiterForce’s recruitment solutions across the European Union (EU), including Outsourced Recruitment, Success Fee, and Retainer Models. By engaging our services, you agree to comply with these Terms, which are designed to align with EU employment and business regulations.

1. Services Overview

RecruiterForce offers flexible recruitment solutions tailored to your business needs:

  • Outsourced Recruitment: Dedicated recruiters employed and managed by
  • RecruiterForce Success Fee Model: Pay per successful hire with an upfront deposit.
  • Retainer Model: Subscription-based recruitment service for a defined period.

2. Outsourced Recruitment

RecruiterForce directly employs and manages the recruiter(s) assigned to the client, including compliance with EU labor laws, payroll, benefits, and HR obligations.

The recruiter will integrate with the client’s team, acting as an extension of their hiring operations. However, all employment and administrative matters remain the sole responsibility of RecruiterForce.

The client must provide the necessary resources, access, and support to enable the recruiter to perform their role effectively.

3. Success Fee Model

A 50% non-refundable deposit is required upfront before the recruitment process begins. The client acknowledges that while RecruiterForce will make reasonable efforts to secure a successful hire, a hire cannot be guaranteed under this model. The remaining balance is due upon the candidate’s acceptance of the employment offer.

4. Retainer Model

Retainer agreements require a minimum contract term of 2 months, reflecting the average time-to-fill for most roles (45-60 days). Retainer fees are payable monthly in advance and are non-refundable. The client is expected to provide clear role specifications, timely feedback, and any relevant documentation to facilitate efficient hiring.

5. General Terms for All Services

a. Payment Terms:

All invoices must be paid within 14 days of issuance unless otherwise agreed upon in writing. Late payments may result in interest charges of 8% above the European Central Bank’s base rate as per EU Late Payment Directive (2011/7/EU).

b. Confidentiality:

Both parties agree to maintain the confidentiality of all shared proprietary and candidate information in compliance with the EU General Data Protection Regulation (GDPR).

c. Data Protection:

RecruiterForce ensures all data handling and processing is GDPR-compliant. Clients are responsible for ensuring the same when handling candidate information.

d. Non-Solicitation Clause:

Clients agree not to directly solicit, hire, or engage any RecruiterForce employees or recruiters during the engagement period and for 12 months thereafter without prior written consent.

e. Candidate Placement Guarantee:

For Success Fee and Retainer Models, RecruiterForce offers a replacement guarantee of 30 days if a candidate leaves voluntarily or is terminated for cause.

f. Liability:

RecruiterForce is not liable for any indirect, consequential, or incidental damages arising from the use of our services. Direct damages are limited to the fees paid for the specific service in question.

g. Termination:

Either party may terminate the agreement with 30 days’ written notice, except in cases where a minimum term applies (e.g., Retainer Model).

h. Governing Law:

These Terms are governed by and construed in accordance with the laws of the European Union and specifically the jurisdiction of Ireland, United Kingdom, Germany, Belgium, Spain, France and Netherlands.

6. Amendments and Modifications

RecruiterForce reserves the right to revise these Terms from time to time. Clients will be notified of any material changes in writing, with a minimum notice period of 30 days for implementation.

7. Dispute Resolution

Any disputes arising under these Terms shall be resolved amicably through negotiation. If no resolution is reached, disputes will be subject to the exclusive jurisdiction of the courts in Amsterdam, Brussels, Dublin.

By engaging RecruiterForce’s services, you confirm that you have read, understood, and agreed to these Terms of Service.
